Baby Toys Import Compliance US & EU Updated 15 October 2026
By Bryant Yeh, International Sales Director, TOYSBASE · 21 September 2026 · 9 min read
Quick answer (TL;DR)
Baby toys bought wholesale in 2026 must clear three gates before they ship:
(1) correct sub-category testing — small parts, migration limits and battery safety;
(2) batch-level traceability that supports U.S. CPSC electronic eFiling at the time of entry; and
(3) complete EU listing metadata that names a responsible person.
The September 2026 CPSC and EU Safety Gate actions all turned on design and test-protocol failures — not production-line accidents.
Since 8 July 2026, CPSC-regulated imports must file certificate data through CBP’s ACE at the time of entry — with no de minimis exemption.
In the 2026 EU Safety Gate sweep of nearly 1,700 online listings, only 58% carried manufacturer details, EU responsible-person information and product identification together.
Freezing, ageing and dishwasher cycles are now mainstream recall triggers — test for misuse, not only as delivered.
Water beads and button-cell items each fall under a mandatory standard beyond the general toy rule.
Compliance is a specification you quote, not paperwork you add later — it protects margin rather than consuming it.
On 3 September 2026, the U.S. Consumer Product Safety Commission (CPSC) announced the recall of about 22,660 Skip Hop Baby Sesame Street Elmo Silicone Teethers in the United States, plus roughly 3,177 in Canada. The hazard was not exotic. The black pupil pieces of the teether’s eyes can detach when the product is frozen — and freezing a teether is exactly what parents do to soothe sore gums. Once separated, those pieces become small parts that can lodge in an infant’s airway. CPSC classified the risk as serious injury or death. No injuries had been reported, but four consumers had already reported eyes coming loose.
If you buy baby toys wholesale, read that as a purchasing instruction rather than news. Imported by The William Carter Company and sold at Carter’s stores and online from January 2025 to March 2026 at around $12, it carried model number 9R263210. The failure surfaced only under an everyday use condition, yet four reports unwound more than 25,000 units across two countries.
Why this matters to a buyer
A single under-tested use condition — freezing — converted a compliant-looking product into a national recall. For an importer, that is not a supplier’s problem alone: the certificate data, the tracking label and the batch file all sit in your customs entry. Compliance has to be specified at the purchase order, not discovered at the port.
Infant and toddler products sit where hazard sensitivity is highest and the rulebook is most fragmented. A teether is a mouth-contact item for a child who cannot follow instructions. That single fact pulls in small-parts rules, migration limits, labelling and, increasingly, separate standards for sub-categories such as water beads and button-cell-powered items. Browse our wholesale baby toys range and you will see why the category is deep — rattles, teethers, bath toys, play mats and walkers all carry different test scopes.
It is also a category that still moves. Circana’s global data, released on 10 August 2026, put toy value sales up 14% in the first half of 2026 year on year, with the twelve months ending June 2026 up 9.5% across the 14 markets it tracks. Infant, Toddler and Preschool Toys remained China’s largest toy supercategory by size, though fourth by growth, largely because of declining birth rates. Demand for higher-quality and more educational products pushed average selling prices up even as volumes fell.

The Elmo teether was not an isolated case. In the same early-September window, CPSC and EU actions included:
Selected infant and small-part recall actions, September 2026 | |||
Product / action | Date & reference | Units | Failure mode |
|---|---|---|---|
Skip Hop Baby Sesame Street Elmo Silicone Teether | 3 Sep 2026 · Recall 26-739 | ~22,660 US + ~3,177 CA | Small part created by freezing |
Squeezy dumpling & squishy bun toys (Chenyuanhui, Amazon) | 3 Sep 2026 | ~8,000 | Water beads expanding beyond permitted size after swallowing |
OKK Trading Rainbow Mystery Squishy Bun (model D08004) | 3 Sep 2026 | ~7,200 | Water beads exceeding permitted expansion |
ZMC Group light-up toys (expanded recall) | 10 Sep 2026 · Recall 26-766 | ~245,124 total | Accessible button cell batteries |
EU Safety Gate — teething toy (France) | Week 32–34 · SR/02199/26 | — | Choking / chemical risk |
EU Safety Gate — rattle (Lithuania) | Week 32–34 · SR/02270/26 | — | Choking risk |
EU Safety Gate — bath toy set (Northern Ireland) | Week 32–34 · SR/02349/26 | — | Choking / chemical risk |
In Europe, the Safety Gate notification batches published around 11 September 2026 (weeks 32, 33 and 34) showed the same two failure modes: choking and chemical risk. Toy entries also included plush keychains, squeeze toys and dolls. Measures ranged from market withdrawal to recall, destruction and rejection at the border.
The pattern is consistent: small parts generated by use or ageing, chemicals that migrate, batteries a child can reach. These are design and test-protocol problems, not production-line accidents. That is precisely why the sub-category matters — the same factory line can produce a compliant baby rattle set and a non-compliant bath toy if the test scope is written for the wrong item.
Since 8 July 2026, CPSC-regulated imports have required electronic filing of certificate data through CBP’s Automated Commercial Environment at the time of entry. The final rule revising 16 CFR part 1110 was published on 8 January 2025 (90 Fed. Reg. 1800); CBP confirmed mandatory enforcement in CSMS message 68290359. Goods admitted from a Foreign Trade Zone have until 8 January 2027.
The certificate itself is not new. The submission is — from “keep it on file” to “file it with the entry.”
There is no de minimis exemption. Small parcels and Section 321 shipments need certificate data if the product requires certification.
No re-testing is required by the rule. Valid reports stay valid; only the transmission changes.
All seven PGA elements must be true at batch level — so the manufacture date, batch number and lab report date have to be fixed before goods ship, not reconstructed once a container is held.
eFiling message sets: what must be submitted at entry | ||

Practitioner tip
Waiting until arrival is what converts a two-day clearance into an examination and a hold. Treat the seven eFiling elements as purchase-order fields, not shipping-desk fields. A supplier who can hand you a complete, batch-traceable file on day one is worth more than a few cents off the unit price — it is the difference between a cleared container and a demurrage line item.
Results released around International Product Safety Week, which ran until 10 September 2026, covered a coordinated sweep of nearly 1,700 online listings for childcare and gym products across 35 marketplaces. Registration improved sharply: 91% of marketplaces had registered in the Safety Gate Portal and named a contact point for authorities, up from 53%. But only 58% of reviewed listings carried manufacturer details, EU responsible-person information and product identification together — roughly 42% fell short. Authorities issued 560 orders to marketplaces over non-compliant listings.
The lesson is direct. Under the General Product Safety Regulation, incomplete listing metadata can pull a product even when the physical toy is sound. Packaging artwork, online listing fields and the responsible-person arrangement are part of the compliance package, not decoration added later by the marketing team. If you are developing your own design rather than buying an existing item, see how we handle OEM/ODM and compliance support and our certification and authority documentation.
Before you sign the next purchase order for infant or toddler products, work through these seven points:
Lock the age grade before you negotiate price Under-3 versus 3-and-over changes small-parts testing, warning statements and tracking-label content. Changing it after sampling invalidates the test report.
Test for misuse, not only as delivered Freezing, boiling, dishwasher cycles, drop and torque testing after ageing. The Elmo recall and the water bead recalls both turned on conditions a parent would consider normal.
Scope the test report to the sub-category Bath toys, teethers, water beads, magnetic products and button-cell-powered products each pull in additional requirements. CPSC recall notices now cite a mandatory standard for water beads; testing laboratories report this stems from a supplementary edition to ASTM F963 that took effect on 12 March 2026.
Make the report traceable to a batch Production date, batch number, manufacturing site, laboratory name and test date must line up with what is actually packed.
Assemble the eFiling data at purchase-order stage Waiting until arrival is what converts a two-day clearance into an examination and a hold.
Review the listing fields, not only the toy EU responsible person, manufacturer identity and product identification must appear together.
Pull samples from production, not only from pre-production A gold sample proves the design; a production sample proves the run you are buying.
Documentation is how these points become a habit rather than a scramble. Our quality control and safety compliance process is set out on the services page, and the frequently asked questions cover the certification questions buyers ask most often.
The compliance burden is rising, but so is the willingness to pay for product that clears it. Circana puts European household spending at roughly $240 per child under ten in 2025, the second-highest level globally. In China, the infant category’s average selling price is rising despite falling volumes, precisely because buyers trade up rather than down.
That is the commercial case for treating compliance as a specification. A buyer who can hand a retailer a complete, batch-traceable file competes on reliability rather than cents per unit — and reliability is far harder for the next supplier to undercut. It also decides which categories are easy to merchandise: classic high-turnover lines such as baby play mats, bath toys and 0–24 month toys reward a supplier who already has the test scope written.
Send the target market or markets, the age grade, the intended retail channel, and any test reports you already hold. Ask the factory to confirm which standards apply to the exact configuration you will ship — ASTM F963 and CPSIA obligations for the US, EN 71 plus GPSR responsibilities for the EU — and to have an accredited laboratory test production-configuration samples. If the item will be sold online in Europe, settle who is named as the EU responsible person before artwork is approved.
The four-line brief that gets a usable answer
1. Target market(s) · 2. Age grade (under-3 / 3+) · 3. Retail channel (offline retail, marketplace, DTC) · 4. Test reports already held. Add the ship configuration and the EU responsible person if the item sells online in Europe.
What certifications do baby toys need for the United States?
For the U.S. market, baby toys must comply with the CPSIA and, for toys, ASTM F963. That means third-party testing at an accredited laboratory, a Children’s Product Certificate (CPC), tracking labels on the product and packaging, and age-appropriate warnings. Sub-categories add requirements: water beads and button-cell-powered items each fall under a mandatory standard that goes beyond the general toy rule.
Do I need to file CPSC certificate data with my customs entry?
Yes. Since 8 July 2026, CPSC-regulated imports require electronic filing of certificate data through CBP’s Automated Commercial Environment (ACE) at the time of entry. There is no de minimis exemption: small parcels and Section 321 shipments still need certificate data if the product requires certification. Goods admitted from a Foreign Trade Zone have until 8 January 2027.
Do I have to re-test products because of the new CPSC eFiling rule?
No. The rule changes how certificate data is transmitted, not what must be tested. Valid test reports stay valid. The change is that the certificate is no longer merely kept on file — it is filed with the entry.
How should a teether or bath toy be tested for small parts?
Test for misuse conditions, not only as delivered. Freezing, boiling, dishwasher cycles, and drop, tension and torque testing after ageing are the conditions that produced the 2026 teether and water bead recalls. Small parts generated by use or ageing are a design and test-protocol issue, so the test plan must include those abuse conditions.
What is an EU responsible person and why does it matter for toy listings?
Under the EU General Product Safety Regulation (EU) 2023/988, an economic operator established in the EU must be named as the responsible person for the product. In the 2026 Safety Gate sweep of nearly 1,700 online listings, only 58% carried manufacturer details, EU responsible-person information and product identification together — roughly 42% fell short. Incomplete listing metadata can pull a product even when the physical toy is sound.
What water bead standard applies in the United States in 2026?
CPSC recall notices now cite a mandatory standard for water beads, which testing laboratories report stems from a supplementary edition to ASTM F963 that took effect on 12 March 2026. Scope your test report to the sub-category, because bath toys, teethers, water beads, magnetic products and button-cell-powered items each pull in additional requirements.
How do I know a shipped batch matches its test report?
Make the report traceable to a batch. Production date, batch number, manufacturing site, laboratory name and test date must line up with what is actually packed. All seven eFiling elements must be true at batch level, so the manufacture date, batch number and lab report date have to be fixed before goods ship — not reconstructed once a container is held.
How do I brief a factory so the compliance answer is useful?
Send the target market or markets, the age grade, the intended retail channel, and any test reports you already hold. Ask the factory to confirm which standards apply to the exact configuration you will ship — ASTM F963 and CPSIA for the US, EN 71 plus GPSR responsibilities for the EU — and to test production-configuration samples at an accredited laboratory. If the item sells online in Europe, settle who is named as the EU responsible person before artwork is approved.
